1 · Accepting these terms

This website is operated by MyAssetPay Pty Ltd ACN 648 613 585, ABN 40 648 613 585, of Level 28, 333 Collins Street, Melbourne VIC 3000 (MyAssetPay, we, us). By using this website you agree to these terms. If you do not agree with them, please do not use the site.

2 · This website is not an offer, and it is not advice

Everything on this website is general information about what MyAssetPay does.

• It is not an offer to lend. No loan exists unless and until MyAssetPay issues you a written loan offer and you accept it. Nothing on this site commits MyAssetPay to lend to anyone, to lend any amount, to lend against any particular asset, or to lend on any particular terms.
• Any figure on this site is indicative. Amounts, rates, terms and charges shown anywhere on this website are general and subject to change. The figures that apply to you are the ones set out in your loan offer, and you see them before you accept anything.
• It is not advice. MyAssetPay is not a bank. Nothing on this website is financial, investment, tax, legal or credit advice, and nothing on it takes account of your circumstances. If you need advice, get it from someone qualified to give it to you.

3 · Victoria only

MyAssetPay lends in Victoria only. Its lending is conducted as pawnbroking under the Second-Hand Dealers and Pawnbrokers Act 1989 (Vic) and the Second-Hand Dealers and Pawnbrokers Regulations 2018 (Vic).

This website can be read from anywhere. That does not mean MyAssetPay can lend anywhere. Nothing on this site is an offer, invitation or solicitation to anyone in any place where making it would be unlawful, and MyAssetPay does not accept applications from outside Victoria.

4 · How you may use this website

You may read, print and share the pages of this website for your own personal or internal business purposes. You must not:

• use the site for anything unlawful, or in a way that interferes with anyone else's use of it;
• attempt to gain unauthorised access to the site, its hosting, or any system connected to it;
• introduce anything malicious;
• scrape, harvest, mirror or systematically extract the site or its content, or use it to train a model, without our written permission; or
• use the MyAssetPay name, logo or content in a way that suggests we endorse you, or that we are associated with you, when we are not.

5 · Accuracy and availability

We take care with what we publish, and we keep it current. Even so, information on this site may become out of date or contain errors, and we may change or remove anything on it at any time without notice.

We do not promise that the site will always be available, or that it will be free of interruption or error. It is a website, not a service you are relying on to hold anything of yours.

6 · Intellectual property

The content of this website — text, layout, graphics, images and code — is owned by MyAssetPay or used under licence, and is protected by copyright and other laws. MyAssetPay is a registered trade mark of MyAssetPay Pty Ltd. Except as these terms allow, you may not reproduce, adapt, publish or commercially exploit any of it without our written permission.

7 · Links to other websites

Where we link to another website — a regulator, a government register, or an organisation we work with — we do so for convenience. We do not control those sites, we are not responsible for their content, and a link is not an endorsement.

8 · Enquiries you send us

If you send us an enquiry through this website or by email:

• sending it does not create any relationship between us, and does not oblige either of us to do anything;
• we will contact you about it, and only about it, unless you ask us for something else;
• please do not send us identity documents, bank details or any other sensitive material with an enquiry. We do not need them at that stage and we will ask for them properly, in the right way, if and when they are needed; and
• the enquiry page explains how what you send reaches us, and our Privacy Policy explains what we then do with it.

9 · Privacy

We handle personal information in accordance with our Privacy Policy, which forms part of these terms. It sets out what we collect, why, who we give it to, how long we keep it and how to access, correct or complain about it.

10 · Referral fees

MyAssetPay may pay a fee to a person or business that refers you to us — most commonly the professional storage provider that already holds your asset. We disclose that arrangement rather than leave you to find out about it. See Referral fees.

11 · Liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

Subject to that, and to the extent the law permits, MyAssetPay is not liable for any loss you suffer from using, or being unable to use, this website, or from relying on general information published on it — and where our liability can be limited rather than excluded, it is limited to re-supplying the information.

This clause is about the website. It has nothing to do with your loan. If you borrow from MyAssetPay, the loan is secured only against the asset you pledge, and MyAssetPay has no recourse to you beyond that asset in any circumstance. Nothing on this page changes that.

12 · Complaints

If something about this website, or about anything else we do, is not right, tell us — email info@myassetpay.com or call 1300 692 770.

13 · Changes to these terms

We may update these terms. The version that applies to your use of the site is the one published here at the time. The version number and effective date are at the top of this page.

14 · Governing law

These terms are governed by the laws of Victoria, Australia. You and MyAssetPay submit to the non-exclusive jurisdiction of the courts of Victoria and the courts that hear appeals from them.
